Make them smile Make them Pay. Understand that most people want to pay their bills, just not right now. Some cant Negoiate arrangements that will work for you and them so you get a win-win situation. provide solutions to problems-- a way out, maybe somethign they hadnt thought about

Listen to them Talk to them not at them Let them know that even though they have talked to others you are going to do everything you can think of to help them out

If they are mad let them vent They arent mad at you but at the situation they are in

One thing is they feel that their credit is ruined now so why should they pay? Educate them that their credit is bruised but is repairable and by making and keeping arrangements with you today they begin to repair the damage

When people used to say their credit was ruined I would tell them if they where 100 years old, didnt own a home, just filed bankruptcy and just learned they had terminal cancer them yes maybe their credit is ruined but that they where much younger and could fix the damage After I explained these things most people where happy to make arrangements with me

Collection agencies can often take a $50 debt and inflate it by hundreds of dollars with fees. Legally, if you so request, they must provide proof of the debt.

Did you tell them to cease and desist all contact or just stop phoning? You have the right to send them a cease and desist all contact letter and they have to stop. Normally, the creditor just brings suit to collect.

However, there isn't any right to tell creditors to stop phoning. You can ask and most will stop calling and just send collection letters. They can also call multiple times a day if you don't answer the phone. They can contact neighbors and family members trying to find you since you aren't answering the phone.

Have you tried contacting social services to see if there is any assistance for your treatments? Or if there is a charity group associated with your illness, maybe they have information on assistance.

From the infamous Hanna Family of notorious debt collectors, West Asset Management (a.k.a. World Wide Asset Mngmnt) is a bottom feeder debt buyer incorporated in NV and run out of Marietta, GA by Fred Hanna (brother to Fredrick J. and his son, Tye Hanna). The Hanna organization has a tainted reputation for lies.

Nothing this organization says or does should be taken at face value; anything and everything should be challenged including any court filings and credit bureau reporting. WWAP is a bottom feeder debt buyer of old portfolios that may be totally lacking in legal validation and possibly out of statutes. The Hanna reputation has always been one that is tainted, dating back more than twelve years, so anyone dealing with WWAP is warned to be very cautious. Paying WWAP will not help you or your credit reports.

Send them the following letter by certified mail/return receipt requested. Use the sample I have included, you just fill in the blanks with your information. Here is their mailing information:

They will have 30 days to verify the debt (which they won't be able to) durring this time they can not contact you or harass you. If you get no repsonse within thiry days, then you can file a dispute with the CRA's to have the entry removed from your report as "unvalidated". Here is a link to do that

Maybe West only subscribes to Trans Union (doubtful).

Maybe TransUnion just made a mistake and added the report to the wrong file. It happens all the time. Contact TransUnion and enter a dispute.

BTW just for your information, these colonials terrace house tenants was told to move out by the government as the revamp is taking place soon. It's announced at the newspaper somewhere in Mar'06.

Sending the dispute to the credit bureau was absolutely the correct thing to do. It could just be a keying error and quickly fixed.

The three credit bureaus are separate companies. You need to pull your report from each and see what shows. You have to file a separate dispute if errors show up on the other reports. It is entirely possible that these accounts won't show up on the other two reports.

West Asset should send you a letter within 5 days of contacting you. This letter should indicate who the creditor is and the amount. This is a requirement of the FDCPA. But they may not comply.

If your dispute to the credit bureaus doesn't get the items removed, send a certified, return receipt letter to each collector requesting validation to include copies of contracts or other documentation proving the debt is yours. Give them 30 days.

If they fail to respond, send another dispute to the credit bureau with a copy of your validation request, indicating they failed to validate. That should get it removed.

If the collection agency continues to bother you, send them a certified, return receipt letter telling them to cease and desist all contact. They have to stop but are likely to sell the debt to another collection agency. You may have to send another cease and desist to the new collection agency.
